Chapter 7 or Chapter 13?

Chapter 7: Fresh Start

  • Wipes out most unsecured debt: credit cards, medical bills, personal loans and old judgments
  • Usually finished in about three to four months
  • You qualify through the means test; household income under the Georgia median for your family size generally qualifies
  • Georgia exemptions let most filers keep their home, car and household goods

Chapter 13: Repayment Plan

  • A three-to-five-year plan based on what you can actually afford
  • Stops foreclosure and lets you catch up missed mortgage or car payments over time
  • Protects property that could be at risk in Chapter 7
  • A good fit when income is too high for Chapter 7 or you are behind on your house

Our experienced team of Georgia bankruptcy lawyers will use every opportunity afforded under the Bankruptcy Code to bring immediate debt relief to you. The bankruptcy laws, as authorized under the U.S. Constitution, offer several options to deal with burdensome debt, whether it is to completely remove the debts or to plan a specific solution to repay the debt over time.

What Filing Stops, and What It Doesn’t

Filing Generally Stops

  • Wage and bank account garnishments
  • Foreclosure sales
  • Car repossessions
  • Apartment and rental evictions (in most cases, if the landlord does not already have a judgment for possession before you file)
  • Lawsuits and collection calls

This protection, the “automatic stay,” starts the moment your case is filed (11 U.S.C. § 362). It can be limited if you had a case dismissed in the past year, so tell us about any prior filings.

Bankruptcy Usually Won’t Erase

  • Child support and alimony
  • Most student loans
  • Most recent income taxes (older income taxes can be discharged in certain circumstances)
  • Criminal fines and restitution
  • Debts from fraud, if the creditor objects in court

Older income taxes can be wiped out in some cases when certain timing and filing requirements are met; we review your tax history at the free consultation. See 11 U.S.C. § 523. Chapter 13 can still help you pay these over time while stopping collection.

Georgia Exemptions: What You Can Usually Keep

  • Home equity: up to $50,000 for cases filed on or after July 1, 2026, and up to $100,000 for most married couples whose home is their shared primary residence (up from $21,500 / $43,000)
  • Vehicles: up to $5,000 of equity
  • Furniture, clothing and household goods: up to $300 per item, $5,000 total
  • Retirement accounts, Social Security, unemployment and veterans’ benefits: generally protected
  • Exemption not used on a home: if you don’t own a home, or don’t need the full home exemption, up to $10,000 of the unused amount plus another $1,200 can protect anything else, including extra equity in a vehicle, furniture, household goods, cash or bank accounts. That is up to $11,200 per person, or up to $22,400 for a married couple filing together.

O.C.G.A. § 44-13-100. In a joint case, each spouse generally claims his or her own exemptions. If you moved to Georgia within the last two years, another state’s exemptions may apply. We review your property during the free consultation.

Bankruptcy Services Included at No Extra Charge

  • Free Consultations: Free consultations with an experienced bankruptcy attorney who has filed hundreds of successful bankruptcy cases, wiping out well more than fifty million dollars ($50,000,000) in total debt for clients.
  • Same-Day Filing if Necessary: Our Georgia bankruptcy attorneys can file an emergency bankruptcy case electronically and very quickly. (The required credit counseling course must still be completed before filing, and it can often be done the same day.)
  • No Tedious Forms for You to Complete: Our attorneys and paralegals complete all of the bankruptcy forms and paperwork for you and file the case with the bankruptcy court. We do not require you to fill out tedious forms before meeting with an attorney or to file your case.
  • We Will Request Your Federal Tax Forms if Needed: If you cannot locate your IRS tax returns, our attorneys can request a tax return transcript on your behalf. This can be very helpful because the bankruptcy trustee must receive your most recent federal tax return (or a transcript) before your meeting of creditors, and Chapter 13 filers must have filed their returns for the last four years.
  • Easy Credit Counseling Options: We offer multiple options for your court-required bankruptcy credit counseling. You can complete the credit counseling in person, by telephone, or from the comfort of your home on the internet. (Counseling must come from an approved agency within 180 days before filing, and a second financial-management course is required before your discharge.)
  • We Will Pull Your Credit Report: We can obtain a copy of your credit report and public records report during your free bankruptcy consultation. We also use these reports to help complete your case, making the listing of all your creditors much easier for you and with verified information for your creditors.
  • We Can Pull Public Records Reports: Not all information required for all bankruptcy cases will always be included in credit reports. That is why we also pull Public Records Reports on most cases to verify that all the information needed for your case to be a success is included in your petition. In addition, businesses do not have credit reports in the traditional sense, so Public Records Reports are frequently necessary for business bankruptcy cases (LLCs, corporations, LLPs, S-corps, etc.).
  • Weekend and Evening Appointments Available: Do you have a busy week? Can you only come in to the office after hours? Just call us at 770-609-1247 and ask for a consultation at a time that is convenient for you.
